Terms & Conditions

This web document represents the entire agreement between the guest and Pula Outdoor, who is the activity provider. Pula Outdoor will be responsible to the guest for providing the services as described at www.pulaoutdoor.com, except where such services cannot be provided, or the itinerary used is changed due to delays or other exceptional circumstances or nature, beyond the control of Pula Outdoor. In such circumstances, we will do our best to provide the first next available date and time for the same activity, offer an alternative activity or offer a full refund if the first two options would not be possible for the guest.

Terms of Use

By using www.pulaoutdoor.com you agree to be legally bound by these terms, which shall take effect immediately. If you do not agree to be legally bound by all the following Terms & Conditions, please do not access and/or use www.pulaoutdoor.com website. Pula Outdoor may change these Terms & Conditions at any time by posting changes online. Please review these Terms & Conditions regularly to ensure you are aware of any changes made by Pula Outdoor. Your continued use of www.pulaoutdoor.com website after changes are posted means you agree to be legally bound by these terms as updated and/or amended.

You may not copy, reproduce, republish, download, post, broadcast, transmit, make available to the public, or otherwise use www.pulaoutdoor.com content (inclusive of text, images, URLs, pricing information, etc.) in any way except for your own personal, non-commercial use. We grant you permission to use the site subject to the restrictions in these Terms & Conditions. In accessing or using the site, you may be exposed to content that is offensive, indecent, inaccurate, objectionable, or otherwise inappropriate. Pula Outdoor does not endorse such content, and cannot vouch for its accuracy. You, therefore, access and use the site at your own risk.

Payments, Cancellations, & Refunds

Pula Outdoor requires 100% of the total activity cost prior to the date of the activity and has the right to cancel a guest’s place on the activity if full payment is not received. A participation form must be completed on arrival before a person can take part in any activity. Pula Outdoor does not accept any liability for loss caused by failure to complete the participation form.

Any cancellations or amendments to your booking must be made in writing and will only be accepted from the date they are received by Pula Outdoor. No refunds are available once a tour or service has commenced.

Refunds for cancellations are as follows

Individual guests:

• 2 days or more before the activity start date = full refund
• 1 day before activity start date = no refund

Tour companies and organised large groups (eg. School classes, Scout groups,…)

• 4 weeks or more before the activity start date = full refund
• 2 weeks before activity start date = 50% refund
• Less than 2 weeks to activity start date = no refund

Privacy and Personal Data Collection

We are committed to providing protection of our guests’ personal data in a way that we collect only essential basic information about our guests that are necessary for fulfilling our obligations. We also inform our guests about the way we collect information and regularly give guests an option about how their information will be used, including the possibility to decide whether their name should be included or omitted from the lists used for marketing campaigns.

All user information is strictly guarded and is available only to the employees who need that information for completing the job. All our employees and business partners are responsible to follow the principles of confidentiality protection.

Your Responsibility

Please note you are responsible for your and your party’s actions. If we believe your actions or those of your party could cause danger, upset or annoyance to other customers, guests or staff, we may end your booked activity immediately. In this event, Pula Outdoor will not pay compensation, make refunds nor pay any expenses you suffer as a result. You are responsible for your personal safety and for the safety of the accompanying people dependent on you. Please take time to understand and then conform to the health and safety rules stipulated by Pula Outdoor or by the appropriate government authorities.

Pula Outdoor assumes no liability in respect of personal injury, loss, damage or third party claims which occur through no fault of their own or their instructors and cannot accept responsibility for any of the reasons cited above that a person may incur whilst participating in any of the activities unless Pula Outdoor can be proven negligent.

The guests accept to participate at their own risk and they confirm that they have their own insurance to cover any such injury, loss or damage or have chosen not to take out such insurance even though they understand that this is their responsibility. All guests have to declare any medical conditions (e.g. asthma, epilepsy etc.) or any other special needs that may affect their or others’ safety whilst participating and accept Pula Outdoor do not accept any responsibility for any conditions not disclosed. Guests will not be permitted to consume alcohol or drugs prior to or during the activity sessions. Staff reserve the right to refuse participation to anyone considered to be under the influence of alcohol or drugs.

Travel Insurance

It is a condition of our contract with you that you and all members of your party have suitable and sufficient travel insurance to cover your journey as Pula Outdoor can not be held responsible for any liability, expenses or losses you incur as a result of being inadequately insured. We strongly recommend that, at the time of booking, a comprehensive travel insurance policy is purchased.

Credit Card Purchase Security Statement

Confidentiality of your information is protected and secured by using SSL encryption. Pages for web payment are secured by using Secure Socket Layer (SSL) protocol with 128-bit data encryption. SSL encryption is a data coding procedure for the prevention of unauthorised access during data transfer.

Safety Standards

The safety standards and regulations are those of the country in question, and not necessarily the same or equivalent standards of your country. The monitoring, enforcement and compliance with local regulations are carried out by the appropriate authorities in the country concerned. We urge you to take all reasonable precautions to protect yourself and your family whilst on holiday.

Complaints

Complaints concerning the activities should be referred to Pula Outdoor management at the end of the session and followed up in writing within 7 days of the activity. Pula Outdoor will act accordingly to do everything possible to rectify the situation and issue a written reply. Disclaimer

To the maximum extent permitted by law, we disclaim all warranties, whether express or implied by statute, custom or usage relating to the information contained in this website and we shall not be liable for any losses or damages whatsoever, whether in contract, tort (including negligence), or otherwise arising from this website, or from any interruption or delay in accessing this website.
